These Terms of Use (“Terms”) form a binding agreement between you and BYMDSIGN (“we,” “us,”“our”), the publisher of the Hony mobile application (the “App”). By downloading,installing, or using Hony, you agree to be bound by these Terms. If you do not agree, do not use the App.
Hony is a party and social game app designed to be played with friends. It offers several gamecategories, including a category (“Never Have I Ever”) built around a drinking-game mechanic. Somefeatures are free; others require a one-time purchase or a recurring subscription, as described in Section6.
Hony is intended for mature audiences (18+, or the equivalent minimum age in your region) due to itsmature themes and alcohol-related content. By using the App, you represent that you meet the legaldrinking age in your jurisdiction if you choose to play categories involving alcohol, and that you are oldenough in your jurisdiction to enter into these Terms.
Hony is a game intended for entertainment among consenting adults. Any consumption of alcohol whileplaying is entirely at your own discretion and risk. We strongly encourage moderation and responsibledrinking, and remind players never to drink and drive. Some game prompts may involve physical actions,personal disclosures, or social dares; participation is always voluntary, and players should use goodjudgment and respect the comfort and consent of everyone present. We are not responsible for anyinjury, harm, embarrassment, or other consequence arising from gameplay, including from theconsumption of alcohol.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, nontransferable, revocable license to download and use Hony on devices you own or control, for your ownpersonal, non-commercial use. All rights not expressly granted to you are reserved by us and ourlicensors.
You agree not to: reverse-engineer, decompile, or disassemble the App except as permitted by law;copy, modify, distribute, sell, or lease any part of the App; use the App for any unlawful purpose or in away that could harm, disable, or impair the App; or use the App to harass, endanger, or pressure anyother person (including pressuring others to consume alcohol against their wishes).
Hony may offer optional premium features unlocked through a one-time purchase or an auto-renewingsubscription (“Premium”). Purchases are billed and processed directly by the Apple App Store or GooglePlay, and subscription management is handled through RevenueCat, our third-party subscriptioninfrastructure provider.
Auto-Renewing Subscriptions
If you purchase a subscription, the following terms apply:
● Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
● Your subscription automatically renews for the same duration and price unless you turn offauto-renewal at least 24 hours before the end of the current period.
● Your account will be charged for renewal within 24 hours prior to the end of the current period,at the price you agreed to at purchase (subject to any advance notice of price changes requiredby law or by Apple/Google policy).
● You can manage or cancel your subscription at any time by going to your Apple ID accountsettings or your Google Play subscriptions, after purchase.
● Any unused portion of a free trial period, if offered, will be forfeited when you purchase asubscription, where applicable.Refunds are subject to the refund policies of the Apple App Store or Google Play, as applicable we donot directly process payments or refunds.
The App relies on third-party services to operate certain features, including Apple Inc. and Google LLC(app distribution and billing) and RevenueCat, Inc. (subscription management). Your use of theseservices is also subject to their respective terms and privacy policies.Please also refer to our Privacy Policy for information on how data is handled in connection with theApp.
The App is provided “as is” and “as available,” without warranties of any kind, whether express orimplied, including but not limited to warranties of merchantability, fitness for a particular purpose, ornon-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmfulcomponents.
To the fullest extent permitted by applicable law, BYMDSIGN shall not be liable for any indirect,incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related toyour use of the App, including any consequences related to gameplay or alcohol consumption asdescribed in Section 4. Nothing in these Terms excludes or limits liability that cannot be excluded orlimited under applicable law.
We may suspend or terminate your access to the App at any time if you violate these Terms. You maystop using the App and uninstall it at any time. Sections that by their nature should survive termination(including Sections 9, 10, 11, and 13) will continue to apply.
These Terms are governed by French law, without regard to its conflict-of-law principles. Subject to anymandatory consumer-protection rules that may apply in your country of residence, any dispute arisingout of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of thecompetent courts of France.
We may update these Terms from time to time to reflect changes in the App or applicable law. The“Effective Date” above indicates when these Terms were last revised. Continued use of the App afterchanges take effect constitutes acceptance of the revised Terms.
